INTERSHORES I Hong Kong Visa

 

After setting up your Hong Kong company or operating the business via the Hong Kong entity overseas, you may want to apply for a visa in Hong Kong.  As an entrepreneur, you can either apply an investment visa or employment visa:

 

Investment Visa - Eligibility

1.    No  criminal records nor pose a security threat.

2.  The applicant has a good education background, preferably with a first degree in the relevant field, but in special circumstances, good technical qualifications, proven professional abilities and/or relevant experience and achievements supported by documentary evidence may also be considered.

3.  The applicant is in a position to make substantial contribution to the economy of Hong Kong, including but not limited to, business plan, business turnover, financial resources, investment sum, number of jobs created locally and introduction of new technology or skills.

4.   The application has a Sponsor in Hong Kong who can either be a company or an individual.  If the sponsor is an individual, he/she should be: of the age of 18 or above, a bona fide Hong Kong resident and acquainted with the applicant.

 

Employment Visa - Eligibility

You can also consider applying for an employment visa (i.e. you are employed by the company):

 

1.   The applicant has no criminal records or security objections.

2.   There is a genuine job vacancy at the employing company.

3.   The applicant has secured a confirmed employment and the job matches the applicant’s academic qualifications or working experience and that the job cannot be readily taken up by the local work force.  The applicant must possess a good educational background preferably at least an undergraduate degree in the relevant field. In the absence of such a degree, documentary evidence of good technical qualifications, relevant professional abilities, achievements and experience may suffice.

4.  The remuneration package including income, accommodation, medical and other fringe benefits is in line with the prevailing market in Hong Kong has to submit at application.

5.   Where the employer is a newly set up company i.e. it has only been set up within the last 12 months, a detailed business plan must be submitted including information on source of funds, estimated capital injection, nature/mode of business activities, expected turnover, sales volume, gross and net profit in the coming years, and proposed creation of local job posts etc.

 

For both the investment and employment visa, successful applicants will usually be granted a two-year visa which they can later extend. 

 

Further, an applicant who wishes to bring his spouse and unmarried children under 18 years of age to Hong Kong can sponsor the application of each of his dependents. Sufficient proof of the dependent's relationship with the sponsor will need to be provided and if granted the length of stay of a dependent will depend on the length of stay of the applicant.

 

Essentially, your aim should be to fulfill the requirements of Immigration Department in Hong Kong as fully as possible. If you have a sponsor, you meet all other requirements of the Immigration Department and can prove that your business will make a significant contribution to Hong Kong then an investment visa is probably a good fit.  Otherwise, you might want to consider applying for an employment visa.
